These Terms and Conditions (“Terms”) apply to your use of bp-shipping.com (the “Website”) and to all shipping, freight and logistics services provided by Black Pearl Shipping Services (“Black Pearl”, “we”, “us” or “our”). By using the Website or our services, you agree to these Terms. If you do not agree, please do not use the Website or our services.

1. Our Services

Black Pearl provides shipping and logistics services including Less Container Load (LCL), Full Container Load (FCL), air freight, sea freight, road transportation, break bulk, worldwide and door-to-door shipping, mainly between the UAE, Iraq and international destinations. The specific scope of each shipment is set out in the quotation, booking confirmation or agreement issued for it.

2. Quotations and Bookings

  • Quotations are based on the information you provide (including cargo type, weight, dimensions, origin and destination) and are valid for the period stated on the quotation.
  • Prices may change if the shipment details differ from what was provided, or due to changes in carrier rates, fuel surcharges, exchange rates, duties, taxes or government charges.
  • A booking is confirmed only once we have accepted it in writing.

3. Your Responsibilities

As the customer or shipper, you agree to:

  • Provide complete and accurate information and documents about your shipment, including invoices, packing lists, permits and licences required for export, transit and import.
  • Make sure goods are properly packed, labelled and suitable for transport.
  • Not ship prohibited, restricted, illegal or dangerous goods unless they have been declared in advance and accepted by us in writing.
  • Comply with all applicable customs, export control and sanctions laws.

You are responsible for any fines, delays, storage costs, penalties or damages that result from inaccurate information, incomplete documents or non-compliant goods.

4. Payment

  • Payment terms are as stated on our quotation or invoice. Unless agreed otherwise in writing, charges are payable before the cargo is released.
  • Customs duties, taxes, VAT, storage, demurrage, detention and other third-party charges are payable by the customer unless the quotation clearly includes them.
  • We may hold goods until all outstanding amounts owed to us have been paid.

5. Transit Times and Delays

Transit and delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs inspections, port congestion, weather, strikes, government action or other events outside our reasonable control.

6. Liability

  • Our liability for loss of or damage to goods is limited to the extent set out in the applicable carrier terms, international conventions and the laws of the United Arab Emirates.
  • We are not liable for indirect or consequential losses, including loss of profit, business or market.
  • Claims for loss or damage must be made to us in writing within seven (7) days of delivery, or of the date the goods should have been delivered.
  • We strongly recommend arranging cargo insurance. We can help arrange insurance on request, at additional cost.

7. Force Majeure

We will not be responsible for any failure or delay in performing our services caused by events beyond our reasonable control, including natural disasters, war, civil unrest, epidemics, strikes, government restrictions or the actions of carriers and authorities.

8. Track & Trace

Tracking information on our Website is provided for convenience and may rely on data from carriers and third parties. While we try to keep it accurate and up to date, we do not guarantee its accuracy or availability.

9. Use of the Website

You agree not to misuse the Website, including by attempting to gain unauthorised access, introducing viruses or harmful code, or using it for any unlawful purpose. Website content is provided for general information and may change without notice.

10. Intellectual Property

All content on the Website, including text, images, logos and design, belongs to Black Pearl Shipping Services or its licensors and may not be copied, reproduced or used without our written permission.

11. Privacy

Your use of the Website and our services is also governed by our Privacy Policy, which explains how we collect and use your personal information.

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any disputes will be subject to the exclusive jurisdiction of the courts of Dubai.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with an updated “Last updated” date. Your continued use of the Website or our services means you accept the updated Terms.
